These Terms and Conditions (the "Terms") are issued by Ali Travel Inc., operating as Maplelux Holidays ("Maplelux Holidays", "we", "us", "our"), a travel wholesaler and retailer registered with the Travel Industry Council of Ontario (TICO Registration #50025124 (Retailer) and #50026847 (Wholesaler)), head office at 350 Hwy 7, Unit 304, Richmond Hill, Ontario L4B 3N2.
Users of this website and purchasers of our travel services are referred to as "the customer", "the user", "the passenger" or "the traveller" ("you"). These Terms apply to all users of the Maplelux Holidays website and to all bookings made directly with Maplelux Holidays or through a travel retail partner. Use of this website, or booking through a travel consultant, constitutes your acceptance of these Terms. If you do not agree with these Terms, contact Maplelux Holidays before using the website or making any reservation. The person making a booking on behalf of other travellers confirms that they are authorized to accept these Terms for every traveller named in the booking.
Nothing in these Terms excludes or limits any right or protection that cannot lawfully be excluded under the Consumer Protection Act, 2002 (Ontario), the Travel Industry Act, 2002 (Ontario) and its regulations, or other applicable law; if any provision is found to conflict with such law, it applies to the maximum extent permitted.
Where a booking is made through a retail travel agent, that agent acts as the agent of the passenger, not of Maplelux Holidays. Travel services are supplied by independent third-party suppliers — including tour operators, airlines, cruise lines, railways, car rental companies, hotels, transfer and excursion operators — who are not employees, agents or partners of Maplelux Holidays and over whom we have no direct control.
In addition to these Terms, you agree to the terms and conditions, rules, regulations and tariffs of every third-party supplier involved in your booking. Supplier terms are made available during the booking process via links to their respective terms and conditions, and are deemed accepted when you complete your purchase. Carriage by air is additionally governed by the applicable airline's conditions of carriage and by international conventions (including the Montreal Convention), which may limit or exclude carrier liability.
It is your responsibility to read and accept these Terms and the applicable supplier terms before purchasing travel services through Maplelux Holidays or through a travel retail partner. Completion of a purchase signifies your agreement with all applicable terms. You must also review the Maplelux Holidays Privacy Policy and any supplier policies relevant to your booking, and verify that all names, dates and details on your confirmation and invoice are accurate immediately upon receipt — corrections requested later may attract supplier fees or may not be possible.
Your reservation is secured once we receive a deposit of $300.00 CAD per person, per travel product, unless a different deposit is stated for a specific product at the time of booking. We then confirm availability with our suppliers, normally within 24 hours. If we are unable to confirm your reservation, your deposit is refunded in full. Once your reservation is confirmed, the deposit is non-refundable except as expressly provided in these Terms (see Sections 6, 9 and 12).
Final payment is due 30 days prior to departure. The deposit option applies only to bookings made more than 60 days before departure; bookings made within 60 days of departure require full payment at the time of booking. If final payment is not received when due, the reservation may be cancelled automatically without further notice, the deposit is forfeited, cancellation penalties under Section 9 apply, and suppliers may impose additional fees; Maplelux Holidays is not responsible for any further consequences of late or missed payment.
Maplelux Holidays accepts all major credit cards for online bookings and bookings made through a travel retail partner. Your verbal or written credit card authorization constitutes confirmation of the reservation and acceptance of all booking conditions, and you agree not to dispute or charge back amounts properly charged in accordance with these Terms. In the event of a payment dispute, you agree to first contact us and allow a reasonable opportunity to resolve the matter under Section 17 (Claims).
All prices are quoted in Canadian dollars unless stated otherwise and, unless indicated, are based on double occupancy. In accordance with Ontario's all-in price advertising rules, our advertised prices include all mandatory fees and charges, with any government taxes disclosed. Prices are subject to change until your booking is confirmed with the required deposit. After confirmation, prices may be adjusted where permitted by Ontario law — for example to reflect government-imposed taxes and fees, or supplier fuel and cost surcharges; consistent with Ontario's travel-industry regulation, if a post-confirmation price increase (other than an increase in retail sales tax or federal goods and services tax) exceeds 7% of the price of the travel services, you are entitled to cancel and receive a full refund of amounts paid, and no price increase is permitted after you have paid in full. Published tour prices are based on airfares, hotel rates, transportation costs, admission fees and exchange rates in effect at the time of publication; where fuel surcharges or currency fluctuations arise before departure, any adjustment we make is subject to the limits above.
Price privacy: the price quoted to each customer reflects their specific booking, timing and promotions, and is treated by us as confidential customer information under our Privacy Policy. We ask travellers, as a courtesy to fellow group members, to likewise treat their own pricing as private and refrain from comparing or discussing individual prices within the group.
Errors and omissions: in the event of an obvious pricing or description error (including electronic or typographical errors), Maplelux Holidays reserves the right to correct the error and, where a booking has been made at an erroneous price, to offer you the choice of paying the correct price or cancelling with a full refund of amounts paid for that booking.
Comprehensive travel insurance — including trip cancellation, trip interruption, out-of-province medical and baggage coverage — is strongly recommended at the time of booking. Maplelux Holidays is not responsible for any illness, injury, death, cancellation, missed connection, weather disruption, political unrest, war, or any other loss incurred before or during travel. In accordance with Ontario's travel-industry regulation, we advise every customer of the availability of trip-cancellation insurance and out-of-province health insurance at the time of booking. If you decline insurance, your booking record will note that coverage was offered and declined, and you assume full responsibility for all losses and expenses that insurance could have covered.
Travellers are solely responsible for ensuring they possess valid passports, visas, health certificates and any other required travel documentation for every country visited or transited. Passports must be valid for at least six (6) months beyond the return date. Entry requirements differ by citizenship and are subject to change without notice; you are responsible for verifying current requirements with the relevant consulates or authorities before departure. Visa processing takes time — apply as early as possible; details of entry requirements are available from our staff or from the embassy or consulate of the country concerned. During travel, keep your passport, travel documents and valuables secure at all times: any loss of documents, and all resulting costs, are the traveller's responsibility. Maplelux Holidays assumes no liability for any cost or consequence — including denied boarding, denied entry, or trip interruption — arising from incomplete, invalid or insufficient travel documentation, and no refund or transfer to another tour will be owed in such circumstances.
Customs, immigration and government authorities: customs and border agencies control the movement of persons and goods under their own national laws. All dealings between a traveller and any customs, immigration, border-control, police or other government authority are outside our control; Maplelux Holidays has no power to intervene in, and accepts no responsibility for, such matters.
Cancellation charges, calculated from the date written notice of cancellation is received by us, are as follows unless a different policy is stated for a specific product at the time of booking:
Reservations that include air segments: once airline tickets have been issued, the air portion of the booking is 100% non-refundable, regardless of the schedule above; the land portion of the booking remains subject to the schedule above. Where tickets have not yet been issued, airline-imposed fees and fare rules may still apply to the air portion.
Supplier-imposed penalties, non-refundable components and insurance premiums are in addition to, and not refundable under, the above schedule where applicable.
Change requests are processed at the sole discretion of Maplelux Holidays and are subject to availability and to supplier rules. Any revised booking will be charged at the rates and conditions applicable to the new product(s) based on the original date of reservation, and change fees may apply. It is the responsibility of the travel agent or the passenger to confirm and accept any additional charges before the modification is finalized. A name change or date change that a supplier treats as a cancellation will be subject to Section 9.
Maplelux Holidays is not liable for any unused portion of travel services — including but not limited to air segments, hotel accommodation, transfers, tours or car rentals — and no refunds will be issued for unused components, whether the non-use is voluntary or involuntary. Guests are responsible for all expenses incurred should they choose or need to return early. Failure to utilize or redeem any tour or travel service at the scheduled time may result in cancellation of the remaining services without refund. A traveller who fails to arrive at the designated departure time and place (for a flight or coach departure) is deemed to have voluntarily abandoned the tour, and no amount is refundable; the airline's obligations are limited to the conditions stated on the ticket, and the airline bears no responsibility to a passenger who does not board. Likewise, a traveller who leaves the tour after departure for personal reasons is deemed to have voluntarily withdrawn, and no refund or compensation is payable for the unused portion.
Cancellation by Maplelux Holidays: where a tour does not reach its minimum number of participants, or other special circumstances require it, we reserve the right to cancel the tour. In that event you may choose to transfer to another available tour or to receive a full refund of all amounts paid for the cancelled tour; to the extent permitted by law, no further compensation is payable. We also reserve the right to adjust itineraries and to substitute hotels of a comparable or higher standard where necessary for the smooth operation of the tour.
Published itineraries are planned in advance; suppliers may need to modify an itinerary due to weather or other acts of God, government regulations, operational requirements, or circumstances beyond their control. Substitutions of hotels, vehicles, vessels or program elements will be of comparable or higher standard where reasonably possible. Such modifications do not constitute a breach of contract and do not entitle the traveller to a refund or compensation from Maplelux Holidays. Nothing in this section affects any right you may have under applicable law where the travel services are cancelled entirely and are not resupplied.
Transportation is provided by air-conditioned motorcoaches, minibuses, 4x4 vehicles, trains, cruises, ferries and flights, as outlined in the itinerary. On certain regional routes, smaller vehicles without onboard restroom facilities may be used, and onboard restrooms may at times be unavailable due to altitude or weather conditions; in such cases additional rest stops will be arranged as needed. Baggage is carried at the owner's risk, subject to carrier terms. The number, weight and dimensions of free baggage are governed by each airline's rules, which change from time to time — verify your allowance with the airline before departure. Coach seating: for fairness when a coach is full, the tour guide assigns and rotates seating and travellers are asked to sit as arranged; travellers who suffer from motion sickness or have similar needs may purchase a front-row VIP seat where offered.
Prices are based on double occupancy. Double and triple rooms are the same category of room: a double room may contain one double bed or two double beds, and a triple room is the same room shared by three guests — depending on the hotel, either without an additional bed or using a rollaway or sofa bed. Triple or quad configurations may be limited and can feel smaller. Room configurations (e.g., bed types) and special requests (such as adjacent or connecting rooms) are subject to availability and are not guaranteed. Hotels may be smoke-free, and smoking in rooms may result in fines charged to the guest. Room sizes, standards and amenities vary by destination and may differ from North American standards; substitute accommodation of a similar or higher standard may occasionally be used.
Travellers must be in suitable physical condition for the tour and its excursions, and are responsible for consulting a physician regarding fitness to travel, vaccinations and health precautions. Special requirements (dietary, accessibility, medical) must be submitted at the time of booking; we will relay them to suppliers, but fulfillment cannot be guaranteed and is not a condition of the contract. Maplelux Holidays may decline or cancel a booking, without liability beyond a refund of recoverable amounts, where a traveller's condition would make participation unsafe for themselves or others.
Travellers aged 80 and over: for their safety, guests aged 80 or above are asked to travel with an accompanying family member or companion under the age of 80. Where that is not possible, participation requires our prior written approval and a signed fitness-to-travel declaration and assumption-of-risk waiver. This policy reflects the genuine physical demands of escorted group touring — extended walking, stairs, long travel days and destinations where medical care may be distant — and we assess individual circumstances in good faith; it is applied to protect the traveller, not to exclude them.
Optional activities offered in destination are operated by third parties with whom the traveller contracts directly; participation is entirely at the traveller's own risk and Maplelux Holidays has no responsibility for them. Prepaid optional activities: a traveller who has paid for an optional activity and is unable or chooses not to participate for personal reasons is deemed to have voluntarily forfeited it, and no refund is payable; where an optional activity cannot proceed for reasons beyond anyone's control (such as weather or political events), the fee paid for that activity will be refunded, and to the extent permitted by law no further compensation is payable.
Travellers must comply with all laws and regulations of the countries visited and follow the reasonable instructions of guides and suppliers. Suppliers reserve the right to refuse service to, or remove from a tour, any passenger whose conduct poses a threat, disturbance, or danger to themselves or others, or disrupts the operation of the tour; in such cases no refund will be payable, and all resulting costs (including repatriation) are the passenger's sole responsibility. To protect the interests of the whole group, the tour leader may cancel the participation of any traveller who deliberately obstructs the group's or the leader's normal activities; in such cases no tour fees are refundable, and Maplelux Holidays bears no responsibility for that person's activities after leaving the tour. You agree to indemnify Maplelux Holidays against claims, damages and costs (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your conduct while travelling.
Travelling with the group: please follow the arrangements of the tour leader and guide during the trip, and advise them before stepping away from the group for any reason (for example a washroom stop); any additional costs caused by a traveller's late return that disrupts the itinerary are borne by that traveller. Guide and driver rest: under Canadian labour rules, tour leaders, guides and drivers may not work more than 12 hours per day; except in an emergency, please do not disturb them after 8:00 p.m., so they are fully rested to lead the following day.
Rented equipment: please take care of any equipment or devices rented through us; where an item is damaged or lost, the rental fee is not refundable and the security deposit may be applied toward the cost of repair or replacement.
Photos shared within the group: by posting photos or messages in a tour group chat, you consent to other group members viewing and re-sharing them; if you do not wish your content to be shared, please say so in the chat or tell the tour leader in advance. Any use of traveller photos by Maplelux Holidays for marketing is subject to our Privacy Policy and separate consent.
Maplelux Holidays is not liable for, and no refund or compensation will be owed by us in respect of, any failure or delay in performance caused by events beyond our or our suppliers' reasonable control, including without limitation: acts of God, weather events, natural disasters, epidemics or pandemics and related government measures, war, terrorism, civil unrest, strikes and labour disruptions, government actions or travel advisories, border closures, mechanical failures, or interruptions of utilities or transportation networks. Where a supplier provides a refund, credit or reaccommodation for such events, we will pass on to you what we actually recover, less non-recoverable costs and reasonable administration fees.
Any issue arising during travel must be reported immediately to the hotel, tour guide or supplier concerned, so that it can be addressed while you are in destination; failure to report an issue at the time it arises may result in denial of the related claim, since the opportunity to remedy it was lost. Claims must then be submitted in writing — through your travel agent, or directly to us if you booked directly — within 30 days of your return. We will acknowledge and investigate claims in good faith and respond within a reasonable time.

These limitations do not apply to liability that cannot be limited under applicable law.
Descriptions, images, maps and other information on this website and in our advertisements and flyers are provided for general guidance only, are subject to change without notice, and do not form part of the contract. Hotel star ratings and similar classifications reflect local standards and are indicative only.
These Terms, and any dispute arising out of or relating to your booking or your use of this website, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario shall have jurisdiction; claims within the monetary limit of the Small Claims Court shall be brought in the Small Claims Court sitting at or nearest to Richmond Hill, Ontario.
Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. No waiver: our failure to enforce any provision is not a waiver of it. Entire agreement: these Terms, together with your confirmation/invoice, the applicable supplier terms and our posted policies, constitute the entire agreement between you and Maplelux Holidays regarding your booking, and supersede any prior oral statements. We may update these Terms from time to time; the version posted at the time of your booking applies to that booking.
